KWANDA REAL ESTATE – TERMS AND CONDITIONS
Effective Date: 23 May 2025
These Terms and Conditions ("Agreement") govern your engagement with Kwanda Real Estate ("Company", "we", "our", "us") in relation to property transactions. By using our services, you agree to be bound by this Agreement.
1. DEFINITIONS
** "Client" refers to any individual or entity engaging with Kwanda Real Estate, including buyers, sellers, or their authorized representatives.
** "Services" refers to property marketing, brokerage, facilitation of sales and purchases, and assistance with legal documentation and title transfer.
2. BUYER TERMS
2.1 Buyer Obligations
Buyers must provide accurate, truthful, and complete information, including valid identification, contact details, and financial readiness.
Buyers must comply with all legal obligations related to the acquisition of property in Rwanda.
Buyers must communicate their property preferences and budget clearly to facilitate appropriate matching.
2.2 Buyer Rights
** Buyers have the right to access property information and view listings without incurring any upfront costs.
** Buyers have the right to be treated fairly, with transparency in all negotiations and communications.
** Buyers are entitled to receive support throughout the purchase process, including guidance on pricing, legal procedures, and documentation.
** Buyers are not obligated to pay any fee to Kwanda Real Estate unless the purchasing process is successful.
** Buyers may engage legal counsel of their choice at any stage of the process.
2.3 Fees
Upon successful acquisition of a property, the buyer agrees to pay Kwanda Real Estate a title processing and finder’s fee of 1% of the final purchase price.
3. SELLER TERMS
3.1 Seller Obligations
** Sellers must provide proof of ownership and other legally required documents such as the title deed and proof of tax compliance.
** Sellers must ensure the property information is accurate and disclose any known defects, encumbrances, or disputes.
** Sellers are responsible for resolving all pending liabilities associated with the property before final transfer.
3.2 Seller Rights
** Sellers have the right to fair and transparent marketing of their property through Kwanda Real Estate platforms.
** Sellers will not incur any fees for listings, marketing, or preliminary consultations.
** Sellers are entitled to timely communication regarding buyer interest and offers.
** Sellers are free to engage in legal review of sale agreements and documentation.
3.3 Fees
** Upon successful sale and title transfer, the seller agrees to pay Kwanda Real Estate an agency fee of 5% of the final property sale price.
** For sellers under an exclusive agreement, the agency fee is reduced to 4%.
4. DATA COLLECTION & PRIVACY POLICY
** We collect client data solely to fulfill our service obligations and improve our offerings. This includes identity verification, contact details, and transaction history.
** All client data is stored securely and protected against unauthorized access, in compliance with Rwanda’s Law No. 058/2021 on the Protection of Personal Data and Privacy.
** Client data is never sold or disclosed to third parties unless required by law or with your explicit consent.
** Clients have the right to access, rectify, or delete their personal data by submitting a written request.
5. PAYMENT TERMS
** All payments related to property transactions must be made through verified and lawful financial channels.
** Kwanda Real Estate’s agency fees are payable only after the title transfer is finalized and do not include taxes, legal fees, or government charges.
** Late payments of agency fees may incur penalties or interest as per the contract.
6. LIMITATION OF LIABILITY
** Kwanda Real Estate can advise but does not guarantee the condition, valuation, or market performance of any property listed.
** Kwanda Real Estate is not liable for misrepresentations made by sellers or for unforeseen issues with properties post-sale.
7. DISPUTE RESOLUTION
** In the event of any dispute arising from or related to this Agreement, parties agree to first attempt mediation.
** If mediation fails, disputes shall be resolved by competent courts within the Republic of Rwanda.
8. TERMINATION
** Either party may terminate the engagement with written notice, provided no binding offer or transaction is in process.
** Kwanda Real Estate reserves the right to terminate services to clients who provide false information or engage in illegal or unethical conduct.
9. MODIFICATIONS TO TERMS
** We reserve the right to update these Terms and Conditions at any time. Material changes will be communicated via our website or email.
** Continued use of our services after changes are posted constitutes your acceptance of the updated Terms.
